Legal and forensic experts discuss possible charges and the chances of Mel Gibson going to jail in an in-depth People report. Everyone wants to know if Gibson may be looking at serious jail time for his part in allegedly abusing ex-girlfriend, Oksana Grigorieva and their daughter, Lucia, physically.
Jail Time and Charges
The first question was if Mel Gibson could go to jail. Jeffery Rubenstein, a former LA prosecutor, tells People, “I doubt it.”
Rubenstein elaborates, “At most, Mel will probably be charged with misdemeanor domestic violence. Oksana’s alleged injuries don’t seem to rise to a felony level and because Mel has no serious prior convictions, that’ll also lessen his chances of a felony.”
The former LA prosecutor told People that while Mel’s threats towards Oksana were horrendous, they aren’t classified as a real crime. He said there needs to be evidence of intent to carry the threats out in order to face a substantial charge. The court may order probation and counseling.
What Could Oksana’s Charges Be in Court?
What do the experts say about the audio recorded tapes? If they were tampered with and editing has been involved, what charges could Mel Gibson’s ex-girlfriend, Oksana, be faced with from the court?
“I wouldn’t be surprised at all if the tapes were altered in some way,” Herbert Joe, a forensic tape analyst from Dallas tells People. “But that doesn’t mean they aren’t authentic. It’s all up to the judge to determine the (overall) trustworthiness of the tapes on the whole.”
As for Mel Gibson accusing Oksana of extortion, what’s the likelihood she’ll be charged with anything on that end? Trent Copeland, an LA criminal defense attorney, said, “It sounds like a far-fetched accusation and more of a basic defensive reaction by his legal team.”
Trent goes on to say the alleged extortion plot is hard to prove. However, in the event she would be found guilty of the criminal act, it would be a felony conviction and carries a penalty of up to one year in jail.
An Expert Weighs in on Domestic Abuse and Child Custody
The court denied Oksana’s motion for full custody of her and Mel’s baby daughter, Lucia. LA family lawyer, Scott Weston, said the judge obviously felt Gibson wasn’t a serious threat to the baby, in spite of how terrifying he sounded in the tapes.
The case is far from over. Weston says, “The judge is certainly going to want to determine if he committed any domestic violence, and if so, the judge can extend restraining orders against him and order him to counseling. This is going to be a long slog of a case with many hearings ahead; there won’t be a quick resolution.”
It could be years for the scandal between Mel Gibson and Oksana Grigorieva to play out in court. The overall discussions from experts maintain Gibson won’t be looking at any serious jail time but mostly probation if convicted and lot of counseling.
